Kazakhstan has initiated legal proceedings against Indonesia’s steel tariffs at the WTO for the first time

Kazakhstan has requested consultations at the World Trade Organization (WTO) due to the additional ad valorem import duties imposed by Indonesia on hot-rolled steel coils originating from Kazakhstan.

The application, submitted to WTO members on April 15, marks the first time Kazakhstan has taken part in the organization’s dispute settlement mechanism as a complainant.

Kazakhstan argues that the Indonesian measures in question are inconsistent with various provisions of the 1994 General Agreement on Tariffs and Trade (GATT), the Anti-Dumping Agreement, and the Marrakesh Agreement Establishing the World Trade Organization. The consultation process serves as the initial stage, allowing the parties to resolve the dispute through negotiations.

Under WTO rules, if the consultations fail to produce a resolution within 60 days, Kazakhstan may request that the dispute be adjudicated by a panel. This process предусматривает moving to the judicial review stage if no agreement is reached between the parties.
