EU General Court rejects Özkan Demir Çelik’s appeal against anti-dumping duties

The EU General Court has rejected Özkan Demir Çelik’s application challenging the anti-dumping duties imposed on non-alloy steel bulb flats originating in Türkiye and China. As a result of the ruling, the 13.6% duty imposed on the İzmir-based producer remains in force.

The European Union’s General Court has delivered its ruling on anti-dumping measures imposed on non-alloy steel bulb flats imported from Türkiye and China. The Court rejected an application by İzmir-based Özkan Demir Çelik Sanayi seeking the annulment of the 13.6% anti-dumping duty imposed by the European Commission.

Steel bulb flats are mainly used to reinforce ship hulls and internal structures. They are also used in offshore platforms and, to a more limited extent, in tramway infrastructure.

Commission launched investigation in 2022

The European Commission launched an anti-dumping investigation into products originating in Türkiye and China in November 2022, following a complaint by Spanish producer Laminados Losal. The Commission imposed provisional measures in July 2023 and introduced definitive anti-dumping duties in January 2024 through Implementing Regulation (EU) 2024/209.

Under the regulation, a 13.6% anti-dumping duty was imposed on products manufactured by Özkan Demir Çelik and other Turkish producers. The duty for products originating in China was set at 23%.

Özkan Demir Çelik challenged two aspects of the methodology

Özkan Demir Çelik raised two objections regarding the methodology used by the Commission to calculate the dumping margin.

The company's first objection concerned the exchange rate date used for sales conducted in different currencies. The Commission used the order date rather than the invoice date in its calculations. Özkan Demir Çelik argued that exchange rate fluctuations between these two dates affected the comparison between domestic market prices and export prices.

The company's second objection concerned the period used to calculate the dumping margin. Özkan Demir Çelik argued that, due to changes in production and sales during the investigation period, separate dumping margins should have been calculated for three-month periods instead of applying a single annual margin.

Court rejects the application

In its judgment in Case T-175/24, dated 2 September 2026, the EU General Court dismissed Özkan Demir Çelik’s application.

As a result of the ruling, the European Commission’s calculation methodology and the 13.6% anti-dumping duty determined for Özkan Demir Çelik remain unchanged.

The investigation covered imports during the period from October 2021 to September 2022.
