EU Court of justice rejects Turkish Steel Companies’ anti-Dumping appeals

The Court of Justice of the European Union has rejected the appeals lodged by companies belonging to the Çolakoğlu and Erdemir groups in connection with the anti-dumping investigation into hot-rolled flat steel products originating in Türkiye.

EU Court of justice rejects Turkish Steel Companies’ anti-Dumping appeals

The Court of Justice of the European Union (CJEU) has announced its decisions in two cases concerning anti-dumping measures on hot-rolled flat steel products originating in Türkiye. On 3 September 2026, the Court rejected the appeals lodged by Turkish steel companies in cases C-498/24 P and C-499/24 P.

General Court decisions upheld

With the regulation dated 5 July 2021, the European Commission imposed definitive anti-dumping duties on certain hot-rolled flat products of iron, non-alloy steel and other alloy steel originating in Türkiye.

Under the regulation, an anti-dumping duty of 7.3% was determined for Çolakoğlu Metalurji and 5% for the Erdemir Group. A duty of 4.7% was applied to Habaş, 5.7% to Ağır Haddecilik and Borçelik, and 7.3% to other Turkish producers.

Çolakoğlu Metalurji and Çolakoğlu Dış Ticaret, together with the Erdemir Group companies, had appealed the decisions issued by the General Court in the cases brought against the regulation in question.

With its decisions dated 3 September 2026, the Court of Justice rejected the appeals and upheld the decisions of the General Court. Thus, the previous decision concerning the anti-dumping measures on hot-rolled flat steel products originating in Türkiye remained valid.

Decisions announced on 3 September

Both cases were included under the trade policy heading in the Court of Justice of the European Union's schedule of decisions dated 3 September 2026. The hearings and the announcement of the decisions in the cases were carried out by the Tenth Chamber of the Court.

In the official InfoCuria records of the Court of Justice of the European Union, case C-498/24 P is listed as “Çolakoğlu Metalurji and Çolakoğlu Dış Ticaret / Commission”, while case C-499/24 P is listed as “Ereğli Demir ve Çelik Fabrikaları and Others / Commission”.

Companies will bear the legal costs

The Court of Justice ruled that Çolakoğlu Metalurji and Çolakoğlu Dış Ticaret, together with three companies affiliated with the Erdemir Group, would bear their own legal costs.

The companies will also pay the legal costs incurred by the European Commission during the appeal proceedings.

Separate review of the duties continues

While the court decisions conclude the judicial process concerning the cases brought against the 2021 anti-dumping regulation, the administrative process regarding the future of the measures continues separately.

Following an application by the European Steel Association EUROFER, the European Commission initiated an expiry review on 6 July 2026 regarding the anti-dumping measures applied to hot-rolled flat steel products originating in Türkiye.

While the Court of Justice's decision concludes the judicial process concerning the current regulation, whether the anti-dumping duties will continue in the coming period will depend on the outcome of the expiry review investigation conducted by the Commission.
