The USA International Trade Court (CIT) has ordered the US Department of Commerce (USDOC) to reconsider the final compensatory duties (CVD) imposed on imports of certain hot rolled flat steel products from South Korea, following Hyundai Steel's questioning of the final decision made.
In 2017, USDOC argued that the USDOC's use of existing facts is not lawful, as the review of the products in question failed to address the shortcomings in the government's analysis submitted by Hyundai Steel.
Respondent-responder Nucor also requested CIT to send the final result back to USDOC to reassess the application of current facts and the CVD rate assigned to Hyundai Steel.
USDOC has been requested to submit results by October 20.
