Chile’s new law imposes greater responsibility on mining companies

Chile's new law on economic and environmental crimes brings significant changes for the mining industry, requiring companies to implement stricter compliance and crime prevention models. The legislation broadens the scope of criminal offenses and introduces higher penalties, including prison sentences and substantial fines, for offenses related to corruption, environmental violations, and financial misconduct.

Chile’s new law imposes greater responsibility on mining companies

Mining companies are now required to establish comprehensive crime prevention systems to avoid liability for crimes committed by employees or third parties. Failure to comply could result in fines up to $8.5 million and, in severe cases, the potential dissolution of the company. The mining sector, which is vital to Chile's economy, must ensure compliance with regulations related to occupational health, environmental protection, and legal obligations.

In terms of environmental crimes, the law also enforces stricter oversight of offenses like illegal water extraction or pollution from mining projects. Prosecutors are collaborating with environmental agencies to rigorously investigate such cases. Companies that fail to comply with environmental regulations could face criminal liability, underscoring the need for the mining industry to align its operations with Chile's evolving legal and environmental standards.
